Live or Die?

I have been doing research on death penalty in Malaysia for my assignment last semester and I have written an essay about it. I welcome any feedback from whomever with opposing view of my stand.

To Live or Let Die in Malaysia

Capital punishment has been practiced in almost every part of the world since many centuries ago. According to Britannica Online Encyclopedia, capital punishment is defined as execution of an offender sentenced to death after conviction by a court of law of a criminal offense. In Malaysia, criminals are sentenced to death penalty for few offences. Some of the serious offences are drug trafficking and murder. These two are the major offences being committed that lead to death penalty in Malaysia. Other than that, there are several offences that also lead to death penalty such as possession of firearms and offences against Yang di-Pertuan Agong. In my opinion, death penalty in Malaysia is not justified because it violates human rights, an innocent person may be put to death, and it is a form of revenge and not a solution to violence committed.

Death penalty violates the human rights. No one has the right to take others’ life in any situation. Article 5 in Universal Declaration of Human Rights says that “No one shall be subjected to torture or to cruel, inhuman or degrading treatment or punishment” and Article 3 says that “everyone has the right to live” (“Universal Declaration of Human Rights”). In Malaysia, death penalty is still used as a form of punishment without taking into account of the offender’s rights to live. Worse, some people claim that it should be extended especially for the rapists and the case of incest (Aliran Monthly). Therefore, death penalty should be abolished to protect human rights. This statement is supported by Amnesty International, saying that death penalty violates these rights and therefore should be abolished (“Death Penalty”). So far, 76 countries has abolished death penalty as a form of punishment completely and fourteen countries abolished death penalty but with an exception to certain cases such as wartime crime. They have not carried any form of capital punishment since the past 10 years(Aliran Monthly). This is a positive move towards human rights and peace.

Apart form that, capital punishment may put an innocent person to death. Some people are convicted of crimes upon their circumstantial evidence and the ability of their lawyer to convince the juries or the judge. Therefore, the chances of an innocent person to be convicted of the crime are higher. This is a situation that is happening in Malaysia. According to the Kuala Lumpur Bar criminal practice committee chairman, Datuk N. Sivananthan, justice is only accessible to those who have the money to hire a good lawyer to defend themselves (“Give poor appellants access to lawyers”). Moreover, discrimination happens in some society. Certain people are sentenced to death based on the judgments of their physical look or social background. For instance, we can look at the situation in the United States. The minority races in the country are the most to be convicted of crimes (Thiroux, 195). According to the sociologists, Victoria Swigert and Ronald Farell, "the defendants charged with criminal homicides in the Eastern city are most likely to be convicted to first-degree murder rather than lesser offences if their physical appearances corresponded to the local psychiatric category"(Braswell, 193). This happens almost in every country including Malaysia. Most of them may be punished because of some sort of prejudice or any other form of discrimination such as racism (Aliran Monthly). Therefore, it can be concluded that crime committed depends on the criminal’s financial state and the prosecutors or judges that they are facing.

Also, capital punishment cannot be used as a form of revenge to crime that a perpetrator has committed. Although there are some people who claims that death penalty deters crime but there is no proper evidence to support this statement (Criminal Justice Legal Foundation). Why killing people who kill people to show that killing is wrong? Everyone deserves a second chance including perpetrators. A case study has shown that a criminal who murdered a boy after he got the ransom, eventually turned out to be useful to the society (Thiroux, 198). Sentencing a criminal to death will not bring the victim back to life. As the civilization advances, more people agree that a criminal should be imprisoned rather than being sentenced to death. This is also because the criminals make contributions while they are in jail (Thiroux, 198). A criminal should be given a chance to make up for his or her mistakes. They should be allowed to make contributions to the society. As long as a person lives, there is always something that we can get from them but nothing will be gained by letting them die. Amnesty International stated that death penalty will decrease the chances for the offenders to rehabilitate.

Briefly, we can say that death penalty is not a proper punishment or a good solution to violence. It does not protect one’s rights, the chance or errors during trial are expectable and it is a form of revenge to the victims. This is very unfair to those who are innocent but because of some mistakes or due to certain circumstances, they are convicted to death penalty. Death penalty should be abolished especially in Malaysia to prevent mistakes and to protect rights of the country’s residents.
